User Agreement

This Agreement – User Agreement (hereinafter referred to as the Agreement) is entered into between , (hereinafter referred to as the Supplier or www.today24.online) and the User.

Under this Agreement, the User entrusts the Supplier with the delivery of an order from the Partner(s) and undertakes to pay for the delivery services.

The following terms are used in this Agreement:

Supplier – SRL, providing delivery services for orders placed using the tools of the Supplier’s website.

Partner – a legal entity or individual enterprise selling goods to the User (restaurant, café, etc.).

User – any individual or legal entity placing an order to purchase goods from a Partner through the Supplier’s Website or Application.

Website – the Supplier’s website on the Internet: www.today24.online, which is an order information system offering Users the ability to search for and order ready-made food sold by Partners of today24.online. The Website is intended for reviewing the range of dishes and beverages and placing orders by the User. The Website today24.online accepts payments from Users for their orders. The obligation to fulfill the order, according to the placed order, lies directly with the Partner of www.today24.online.

Services – providing free access to the Supplier’s website materials for reviewing the range of dishes and beverages of Partners, placing an order, and its delivery.

Order – the User’s offer to provide delivery services and sell the Partner’s products in the requested quantity of dishes and beverages, type, and amount of payment. The order is placed through the Website and is considered accepted if confirmed by the Supplier or the Partner, in case the Partner handles the delivery independently.

Applications – a program designed for reviewing the range of dishes and beverages, placing orders by the User, operating on mobile platforms, distributed by the Supplier (details of the distribution terms are specified on the Website).

This Agreement is deemed concluded from the moment the User performs one of the following conclusive actions:
registration on the website www.today24.online (hereinafter referred to as the “Website”);
placing an order by the User without authorization on the Website;
placing an order through the Contact Center phone number of www.today24.online.

This Agreement is equivalent to a contract drawn up in written form. Concluding the Agreement means that the User has reviewed the terms of this Agreement to the extent necessary and fully and unconditionally agrees with them, including consenting to www.today24.online processing the User’s personal data as specified in Articles 38-50, and consenting to receiving email, SMS, and other types of informational and promotional communications, including from Partners of www.today24.online.

Neither party to the Agreement shall engage in unlawful actions when reviewing this Agreement (such as providing false information), and each party may seek judicial remedies and file a claim for violation of this Agreement.

The terms of the Agreement are:

The User, by placing an order, expresses their intention to receive the Supplier’s Services and pay for them.

The User provides the Supplier with accurate information about themselves.

The Supplier reserves the right to verify any information provided by the User.

The User’s registration data is subject to the provisions of legislation on commercial secrets and personal data protection of the Republic of Moldova.

The Supplier undertakes to restrict access to the personal information provided by the User to third parties.

The Supplier undertakes to deliver the Order.

The User undertakes to pay for the Supplier’s Services.

The User agrees that all services are provided “as is” and that the Supplier, while making every effort to fulfill the Order, cannot absolutely guarantee the quality of services, which are not immune to malfunctions or failures. Certain circumstances, primarily technical failures or actions/inactions of the Partner, and others, may hinder the fulfillment of the Order. The User agrees that today24.online is not responsible for the quality of the supplied products, delays, failures, incorrect or untimely delivery, deletion or loss of any user personal information, or failures in payment systems.

The User is informed that when ordering Services from multiple Partners of the Supplier, the delivery of these orders to the User may not occur simultaneously.

The User may independently place an Order on the Website or through the Contact Center phone number 060 021 021.

To use the services of www.today24.online, it is necessary to have a computer or other device with Internet access.

When placing an Order, the User may pay for the Service in the following ways:
pay for the Order upon receipt from the Supplier in cash or other methods provided by today24.online, directly upon receiving the Order;
pay online on the Website using a VISA/MasterCard bank card through the payment system of the partner bank of today24.online.md. The amount charged is the cost of the goods and delivery services.

All settlements between the parties are made in the currency of the Republic of Moldova (in Moldovan lei).

In case of the User’s refusal of the Order, or in case of violation by Partners of today24.online of the terms of product fulfillment, including but not limited to: unilateral refusal to fulfill the product, or non-compliance with the quality of the product, etc., the User must, within 2 hours from the time of delivery/receipt of the order, notify today24.online by email at info@today24.online of their refusal of the Order, providing documents confirming payment for the order, and request a refund of the paid funds.

Refunds within 2 (two) days from the moment of payment for the order are made by the Partners of www.today24.online or today24.online.

After 2 (two) hours and in the absence of notification from the User to www.today24.online about the refusal of the order and refund, the order is considered fulfilled, and the funds paid for it are non-refundable.

www.today24.online reserves the right to refuse the User in placing an Order with the payment method 'cash' or 'online payment' if previously placed Orders by the User were not delivered due to their fault. (For example, if the User did not open the door or answer the phone to the courier during delivery, or the User provided a non-existent delivery address, or the User refused the order after it was prepared, etc.)

The User confirms that they will not use the Services for illegal or unlawful purposes, nor allow third parties to do so. While using the Services, the User guarantees compliance with the legislation of the Republic of Moldova.

The User may not copy, republish, post, publish, enter into a database, display, modify, transmit, or perform any other actions with the content of the Website.

The User agrees to undergo the registration procedure on the Website, providing truthful, accurate, and complete information about themselves in response to the questions in the registration form, expressing agreement with the terms of the Agreement by confirming the “I accept the terms of the Agreement” clause.

If the User provides inaccurate information or today24.online has serious grounds to believe that the provided information is incorrect, incomplete, or inaccurate, today24.online reserves the right to suspend or cancel the User’s registration and deny them the use of its services.

Upon completion of the registration process, the User receives a login and password for access to the personal account and is responsible for the security of their login and password, as well as for everything done on today24.online under their login and password.

The User agrees to immediately notify www.today24.online of any unauthorized (unpermitted) access with their login and password and/or any security breach.

The User agrees that all Orders placed by them through the Website are authorized and subject to payment.

By using the Website, the User confirms their consent to receive informational and advertising messages at the contact details provided, in accordance with the Republic of Moldova’s law on advertising No. 1227 of 06.1997.

By placing an Order, the User confirms that they have reviewed all provisions of the Agreement, understand all terms, agree to comply with them, grant the Supplier the rights outlined in the Agreement, and undertake to pay for their Order.

The Website contains materials protected by copyright and related rights legislation, trademarks, and other legally protected materials, including but not limited to: texts, photographs, and graphic images.

All content of the Website is protected by copyright as a work created as a collective work in accordance with the legislation of the Republic of Moldova on copyright and related rights.

today24.online holds the copyright to the use of the Website’s content (including the right to select, arrange, systematize, and transform the data contained on the website today24.online, as well as the original data itself), except in cases specifically noted in the content of materials published on the website.

The User is not entitled to modify, publish, transmit to third parties, participate in the sale or assignment, create derivative products, or otherwise use, partially or fully, the content of the Website. The User undertakes to use the Website only for lawful purposes.

The User undertakes not to post on the Website or send through/via the Website any materials of the following nature:
violating legislation, containing threats or insults, defaming others, violating citizens’ rights to privacy or public order, or being obscene;
infringing to any extent on the honor and dignity, rights, and legally protected interests of others;
promoting or containing calls to incite religious, racial, or ethnic discord, containing attempts to incite hostility or calls to violence;
other materials that encourage others to engage in unlawful behavior entailing criminal, civil, or other liability or otherwise violating the provisions of the legislation.

The User undertakes not to post on today24.online or send through/via the Website materials that advertise any goods or services without obtaining prior explicit consent from today24.online.

The User undertakes not to use today24.online for advertising or otherwise promoting the sale of any goods and services in any form, including but not limited to encouraging users to subscribe to another interactive service system.

The User undertakes not to upload, post, or otherwise use on the Website any materials protected by intellectual property legislation (including copyright and trademark laws) or other legally protected materials without obtaining explicit permission from the rights holder of the protected material. The burden of proving that the materials posted by the User on the Website do not violate the copyright, related, or other rights of third parties, as well as the responsibility for illegal posting, lies with the User.

The User acknowledges and agrees that the services of today24.online and all necessary applications related to them contain confidential information protected by national and international intellectual property legislation. The User agrees not to modify, sell, or distribute the content and programs, in whole or in part.

The Supplier undertakes to provide delivery services in accordance with the Order placed by the User.

The Supplier is not responsible for the accuracy, relevance, and completeness of the Partners’ product range.

The Supplier is not responsible for the quality of the supplied products or for Website malfunctions.

The User’s personal data is processed in accordance with the Republic of Moldova’s law “On Personal Data Protection” No. 133 of 08.07.2011.

Upon registration on the website www.today24.online, the User provides the following information: Name, email address, contact phone number, and delivery address.

By providing their personal data during registration/order placement on today24.online, the User consents to their processing by www.today24.online, including for the purpose of fulfilling today24.online’s obligations to the User under this User Agreement, informing Users about its services, promoting today24.online’s goods and services, conducting electronic and SMS surveys, monitoring marketing campaigns, providing customer support, organizing delivery of goods to Users, conducting prize draws among Users, monitoring User satisfaction, and the quality of services provided by delivery services. It is not considered a violation for today24.online to provide information to partners, agents, and third parties acting under contracts with today24.online to fulfill obligations to the User.

By agreeing to the terms of the Agreement, the User gives their specific, informed, and conscious consent to the processing of their personal data by the Supplier in accordance with the Republic of Moldova’s law on personal data protection.

Processing of personal data refers to any operation or set of operations performed on personal data, whether by automated means or otherwise, such as collection, recording, organization, storage, retrieval, adaptation or alteration, extraction, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure, or destruction.

today24.online reserves the right to send informational, including promotional, messages to the User’s email and mobile phone with their consent. The User may refuse to receive promotional and other information without explaining the reasons for the refusal. Service messages informing the User about the order and its processing stages are sent automatically and cannot be rejected by the User.

Withdrawal of consent for the processing of personal data is carried out by sending a message to the email address info@today24.online or by editing the User’s profile.

today24.online is entitled to use “cookies” technology. “Cookies” do not contain confidential information, and today24.online may share information about “cookies” with Partners, agents, and third parties that have contracts with today24.online for fulfilling obligations to the User and for statistical and advertising optimization purposes.

today24.online receives information about the IP address of the visitor to the Website www.today24.online. This information is not used to identify the visitor.

today24.online is not responsible for information provided by the(MouseButtonEventArgs User on the Website in a publicly accessible form.

today24.online is entitled to record telephone conversations with the User. In doing so, today24.online undertakes to prevent unauthorized access to information obtained during telephone conversations and/or its transfer to third parties not directly involved in fulfilling orders, in accordance with paragraph 7) of Article 11 of the law “On Access to Information”.

Data posted on the Website or in the Website’s database is the property of the Supplier and is protected by copyright and related rights legislation, commercial secrets, and personal data protection laws of the Republic of Moldova.

Data belonging to the Supplier may not be transferred in any way to any individual or legal entity without the prior written consent of the Supplier.

In case of a violation of the Agreement by the User, the Supplier reserves the right to suspend, restrict, or completely terminate the User’s access to the Services. Termination of service provision does not limit the Supplier in other measures and rights.

The text of the Agreement may be amended without any special notification. Changes will be published on the Website. The amended Agreement takes effect three (3) days after its publication, unless otherwise specified in the amended Agreement. The current version of the Agreement is always available on the Website at www.today24.online/.

This Agreement is governed by the current legislation of the Republic of Moldova.

All possible disputes regarding the Agreement are resolved in accordance with the norms of the current legislation of the Republic of Moldova.

Nothing in the Agreement can be understood as establishing agency relations, partnership relations, joint activity relations, personal hiring relations, or any other relations not expressly provided for in this Agreement between the User and today24.online.
